The New York Times reports that a new rule released by the Commission on Human Rights states that "While covered entities may attempt to justify certain categorical exclusions based on maternal or fetal safety, using safety as a pretext for discrimination or as a way to reinforce traditional gender norms or stereotypes is unlawful." Of course, this also applies to foods that might otherwise be deemed as "too risky" for moms to be—like raw fish and soft cheeses. Meanwhile, there are 18 states that deem drinking while pregnant as child abuse. However, the Times notes, is this issue one of personal etiquette or public policy? And will it lead to other cities and states rethinking their rules?
