A man with a severe nut allergy was served almond milk in his coffee at a Starbucks, and he is now suing the coffee company.
The customer, Max Scher, who considers himself a dedicated client said he was making a coffee run to one of Starbucks' Oregon locations in May. He made it clear in his order that he wanted his coffee made with soy milk and not nut milk. “Hey, I have an allergy,” he always reminds their staff, which he told the The Oregonian in an interview. “Please be careful.”
Once he got his drink, which had "soy milk" labeled on the cup, he went on to drinking it since he thought by the label that it was for sure not a nut milk, but realized it was made wrong after three sips. At that point, he felt his throat closing up and had major difficulties breathing. Scher had his EpiPen and injected himself with it, then took a couple of Benadryl pills before rushing to the nearest emergency room.
Because of this near-fatal experience, Scher is suing Starbucks for $10,000.
Starbucks has released a statement on the incident:
Our partners (employees) take great care in ensuring each one of our customers’ beverages are customized as ordered. We take allegations like this seriously and are thoroughly investigating this situation.
Although this occurred months ago, he is filing this lawsuit now as the medical bills for the reaction wound up costing him more than $4,000.
